Bankruptcy claim seller checklist

Prepare the claim. Keep the process moving.

Start with the basics, then assemble the records needed to confirm ownership, value, and authority. Requirements depend on the transaction.

01 / Identify the parties and asset

Exact creditor legal name, debtor entity, case number, claim number if available, claim type, and unpaid amount. Flag related debtors and avoid combining separate claims without explanation.

02 / Support the balance

Proof of claim or schedule reference, invoice ledger, invoices, contracts, purchase orders, and credits or payments received. Include amendments and correspondence about disputed amounts.

03 / Explain ownership and restrictions

Identify prior assignments, factoring arrangements, liens, settlements, objections, and rights already sold. Explain any restrictions on transferring the asset.

04 / Confirm authority

Identify the owner and the person authorized to sign. Representatives should have the client’s permission to discuss the asset and share supporting documents.

05 / Review the closing terms

Confirm consideration, deductions, holdbacks, funding conditions, purchased rights, representations, recourse, and cooperation duties. Keep a copy of the executed agreement and transfer evidence.

06 / Provide payment details privately

When the transaction is ready, use the authorized payment-instructions step. Do not include account numbers in inquiry forms, question threads, or ordinary email. Independently verify any request to change bank details.
